Barnett on the Problem of Legitimacy

At my own blog I have posted some questions on governmental legitimacy that arose from my reading of Randy Barnett's Restoring the Lost Constitution. I am not offering a full review of the work (see this one by Tim Sandefur instead), but I do hope to start a series of discussions on various topics to be found within it. I am surprised to hear that the Constitution has been "Lost." It appears to me to be functioning just as a few of the Founders predicted, toward a centralization of power which Spengler defined as the essence of Empire. Along that path, the power of the States has been eroded, as has that of the protection of Individual Rights.
We seem to be progressing along the same path as other Empires in History, with the masses, stirred on by various parties and interest groups shouting -- "Viva Caesar!" American Exceptionalism, Bah,Humbug!
